1. Definitions

Service: the FeatureBench online platform and any related features, content or applications. User: anyone who accesses or uses the Service. Account: a registered User profile with unique credentials. Content: text, images, forms, data, submissions or other materials uploaded by Users.

2. Acceptance of Terms

By accessing or using the Service you agree to these Terms. If you don’t agree, do not use or access the Service.

3. Changes to Terms

We may modify these Terms at any time. Revised Terms take effect upon posting at https://featurebench.com/terms. Your continued use constitutes acceptance.

4. Eligibility & Account Registration

  • You must be 18 years or older to register.
  • Provide accurate, up-to-date information.
  • Secure your credentials; you’re responsible for all activity on your Account.

5. Fees, Billing & Payment

  • All fees are in USD and processed via Stripe.
  • You authorize FeatureBench to bill your chosen payment method.
  • If payment fails, we may suspend or terminate your Account or limit access to services until resolved.
  • Payments may take place off-session without explicit consent for each transaction

6. Refund & Cancellation Policy

  • 14-day money-back guarantee from first payment.
  • Cancel anytime, but fees paid are not refundable unless within the first 14 days from the first payment.

7. License to Access the Service

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable license to access and use the Service for your internal event-management purposes.

8. User Content & Intellectual Property

  1. Your Representations
    • You own or have rights to all Content you upload.
  2. Assignment of Rights
    • You hereby assign to FeatureBench all worldwide right, title and interest in and to your Content, including all intellectual property rights.
  3. License to Other Users
    • You grant other Users a license to view and access your data.
  4. Our Use
    • FeatureBench may host, reproduce, modify and display your Content to provide and improve the Service.

9. Our Intellectual Property

All software, trademarks, logos, designs, graphics and text on the Service are owned by FeatureBench or its licensors. You may not copy, distribute, modify or create derivative works without our express written permission.

10. Prohibited Conduct

You agree not to:

  • Use the Service for unlawful purposes or to solicit criminal activity.
  • Harass, abuse or harm another person.
  • Upload malware or other harmful code.
  • Reverse-engineer, decompile or otherwise attempt to access source code.

11. Third-Party Services & Links

  • We integrate with Stripe for payments. Your use of Stripe is governed by Stripe’s terms.
  • The Service may contain links to third-party websites; we’re not responsible for their content or practices.

12. Privacy

Your privacy is governed by our Privacy Policy. We collect device fingerprints, IP addresses, email, name and any data you or your form respondents provide.

13. Disclaimers

  • AS-IS: The Service is provided “as is” and “as available.”

14. Limitation of Liability

To the fullest extent permitted by law, FeatureBench’s total liability for any claim arising from or relating to the Service shall not exceed the fees you paid in the 6 months preceding the claim. Under no circumstances shall we be liable for any indirect, incidental, special or consequential damages.

15. Indemnification

You agree to defend, indemnify and hold harmless FeatureBench and its officers, directors and employees from any claim, demand or damages, including reasonable attorneys’ fees, arising out of:

  • Your use of the Service.
  • Your Content.
  • Your breach of these Terms.

16. Termination

  • You may close your Account at any time by emailing [email protected].
  • We may suspend or terminate your access for violations of these Terms or non-payment.

17. Governing Law & Dispute Resolution

  • These Terms are governed by the laws of the State of Ohio, USA.
  • Arbitration: All disputes will be resolved by binding arbitration in Ohio, under the American Arbitration Association’s rules.
  • You and FeatureBench each waive any right to a jury trial or class-action.

18. Force Majeure

FeatureBench is not liable for delays or failures caused by events beyond our reasonable control (e.g., natural disasters, strikes, acts of war, Internet outages).

19. Assignment

You may not assign or transfer your rights under these Terms without our prior written consent. We may assign without restriction.

20. Severability

If any provision is held invalid or unenforceable, the remaining provisions remain in full force and effect.

21. Waiver

No failure or delay in exercising any right under these Terms will constitute a waiver of that right.

22. Entire Agreement

These Terms, together with our Privacy Policy and any additional term posted on the Service, constitute the entire agreement between you and FeatureBench.

23. Notices

We may provide notices by posting on the Service or emailing the address you provided. You agree that such notices are effective.
